The rules behind the clock

Three deadlines Ontario contractors get caught on

28 / 7 / 7

Prompt payment

The owner pays a proper invoice within 28 days. Each level down pays within 7 days of being paid. Disputes need a written notice of non-payment, on time.

New in 2026
14 days

Annual holdback release

The 10% holdback is now released every contract anniversary. The owner posts a notice within 14 days, and the GC passes holdback down within 14 days of getting it.

90 days

WSIB clearance

Clearances last up to 90 days. Let work run on a lapsed one and you can be liable for the sub's unpaid premiums, up to the labour value of the contract.

Questions

Before you rely on a date

What if a deadline lands on a weekend or holiday?

The clock counts calendar days. Dates that fall on a weekend or Ontario statutory holiday are flagged so you can check your contract and act a day early to be safe.

My contract was signed before 2026. When is the first holdback release?

Most construction law firms read the transition rule as the second contract anniversary after January 1, 2026, and that's what the calculator uses. Firms read it differently for contracts signed before 2024, so confirm with your lawyer.

I'm a sub. How do I know when the GC's invoice went to the owner?

Ask your GC. It sets the whole payment chain. If you know the day the GC was paid, enter that instead and the calculator works from it.

Is this legal advice?

No. Payment Clock works out dates from the Construction Act and WSIB rules. It doesn't review your contract. Confirm anything important with a construction lawyer.
